NEW LAWS TAKING EFFECT IN JUNE & JULY 2021

Though many laws, rules and regulations often take effect on January 1st, employers in California need to be prepared for the following effective dates and deadlines in June and July 2021.

COVID RESTRICTION REMOVAL

Most of the State’s restrictions for indoor and outdoor settings are being removed on June 15, 2021.  Vaccine verifications and COVID testing will only be required for indoor events that are large, such as sporting events.  Of course, California employers will still need to comply with Cal/OSHA’s Emergency Temporary Standards discussed below.

CAL/OSHA ETS STANDARDS REVISED

Cal/OSHA revised the COVID-19 Prevention Emergency Temporary Standards, and these are likely to take effect on June 15, 2021.  Cal/OSHA has recently adopted revisions to the Emergency Temporary Standards (ETS) due to the drop in COVID-19 cases and the significant number of persons who have received vaccinations.  The revisions were approved by Cal/OSHA on June 3, 2021, with a ‘likely’ effective date of June 15, 2021.  Employers are required to be in compliance through the effective date of the revisions to the ETS.

EEO-1 DEADLINE FOR SUBMISSION IS JULY 19, 2021

The Equal Employment Opportunity Commission announced that the 2021 and 2020 EEO-1 Component 1 data report is to be submitted no later than July 19, 2021.  EEO-1 data is required for employers with 100 or more employees and certain employers who are federal contractors with 50 or more employees.  The EEO-1 report includes “demographic workforce data, including data by race/ethnicity, sex and job categories.”

CALSAVERS RETIREMENT PLAN REQUIREMENT

CalSavers is a California state-administered retirement plan.  Employers with more than 50 employees must register with CalSavers by June 20, 2021, if the employer does not have an employer-sponsored retirement plan.  The State is phasing in the registration requirement by the number of employees, as follows:

  1. September 30, 2020 for employers with more than 100 employees;
  2. June 30, 2021 for employers with more than 50 employees; and
  3. June 30, 2022 for employers with more than 5 employees.

CITY AND COUNTY MINIMUM WAGE INCREASES ON JULY 1, 2021

Although California’s minimum wage rates were increased on January 1, 2021 to $13/hour (25 employees or less) / $14/hour (26 employees or more), there are local minimum wage rates which are increasing on July 1, 2021.

On July 1, 2021, the following county and cities will have an increase in the minimum wage rate for the respective jurisdiction:

  1. Berkeley: $16.32/hour.
  2. Emeryville: $17.13/hour.
  3. Fremont: $15.00/hour for employers with 25 employees or less and $15.25/hour for employers with 26 or more employees.
  4. Los Angeles County (for unincorporated areas): $15.00/hour.
  5. Los Angeles City: $15.00/hour.
  6. Milpitas: $15.65/hour, including businesses which perform 2 hours of work per week in the city.
  7. Pasadena: $15.00/hour.
  8. San Francisco: $16.32/hour.
  9. Santa Monica: $15.00/hour.
